License
We grant you a personal, non-transferable, non-exclusive license to use Phaseboard on Apple devices associated with your Apple ID. Your use is also subject to Apple's App Store and iTunes Services Terms of Service; where those apply they govern your relationship with Apple.
In-app purchases
Phaseboard's core features are free. Pro features are unlocked through one of the following purchases through the App Store:
- Lifetime — a one-time, non-recurring purchase that grants the Pro entitlement permanently to your Apple ID, including via Apple Family Sharing.
- Yearly subscription — auto-renewing subscription that grants the Pro entitlement for one year per billing cycle.
- Monthly subscription — auto-renewing subscription that grants the Pro entitlement for one month per billing cycle.
Free trial
New monthly and yearly subscriptions include a 7-day free trial. You will not be charged during the trial. If you do not cancel before the trial ends, the subscription begins automatically and the first period is charged to your Apple ID.
Auto-renewal
Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. The renewal is charged to your Apple ID at the price displayed at the time of renewal. Prices may change with prior notice through Apple.
Cancellation
You can cancel at any time through Settings → Apple ID → Subscriptions on any Apple device. Cancellation takes effect at the end of the current billing period; you keep Pro until then. After Pro ends, all your data remains. You simply cannot create new projects above the free limits (3 active, 5 inbox ideas) until Pro is re-activated.
Refunds
All purchases are processed by Apple. Refund requests are handled by Apple at reportaproblem.apple.com within Apple's eligible refund window. Lifetime purchases are subject to the same Apple refund policy. If you believe a refund is warranted due to a problem on our side, write to support@phaseboard.app; we will help where we can but the refund itself goes through Apple.
Acceptable use
You may not (a) reverse engineer, decompile, or attempt to derive the source code of the app beyond what applicable law allows; (b) circumvent the Pro entitlement check; (c) use Phaseboard for any unlawful purpose; or (d) resell, sublicense, or transfer the app outside of Apple Family Sharing.
Your content
You retain full ownership of all content you create in Phaseboard (projects, tasks, notes, photos, ideas). We claim no rights over it. Because we do not collect your content (see the Privacy page), we have no way to access, modify, or republish it.
Disclaimer of warranties
Phaseboard is provided "as is" and "as available". We work hard to ship a stable app but we cannot guarantee that it will be free of bugs, that iCloud sync will be uninterrupted, or that all features will be available at all times. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.
Limitation of liability
To the maximum extent permitted by law, Xxxxxxx Systems is not liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of data, profits, or business opportunity. Our total cumulative liability arising out of or relating to Phaseboard is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) ten US dollars. Nothing in these terms limits liability that cannot be limited by law.
Changes to the terms
We may update these terms when we change how the app works, when Apple's policies change, or to fix mistakes. Substantial changes will be noted in the app's changelog and on this page. Continuing to use Phaseboard after a change means you accept the updated terms.
Governing law
These terms are governed by the laws of Scotland. Disputes arising from or relating to Phaseboard or these terms shall be resolved in the courts of Scotland, except where overriding consumer-protection laws of your country of residence apply.
